I've known this.

Run. Don't try to fix it, just run.

MurgatroidMendelbaum - 2014-08-17

We must get her address to the MRA immediately.

Rodents of Unusual Size - 2014-08-17

She should just take another trip to Africa. Particularly Liberia. Tell her it's lovely this time of year.

StanleyPain - 2014-08-17

For those curious, his ex is Tabatha Southey, a writer for the Globe and Mail in Canada, and I believe she also has a blog and twitter. It's mostly opinion stuff, often slanted towards humor though I think she's about as funny as cancer. Her writing is mostly that sort of generic columnist crap that most online newspapers are rife with, where the author just repackages the same opinion column 50 other writers just published, changes a few things, and tries not to say anything too controversial or anything that leans too far in one direction.
To the best of my knowledge she has said very little about the whole divorce issue, but her brainless fans generally try to paint Foley as a "deadbeat dad" despite the fact he is expected to pay more money monthly than most people make in a year and she has never been under any sort of legal obligation to ever prove that the money goes towards his kids in any meaningful way.

BorrowedSolution - 2014-08-17

She ugly.

Anaxagoras - 2014-08-18

It's not "brainless" to call him a deadbeat dad. Southey's lawyer claims that the extremely high monthly payments were incurred when his income was high, and he stopped paying them back then. Since then he (supposedly) hasn't had the ridiculously high payments. I don't know if all that is true, but it does provide a feasible alternative explanation that non-brainless people could believe.

Also, Southey *shouldn't* be obligated to show where the money goes. Why the fuck should she? She's not entering into indentured servitude, you asshole. "We'll only give you money if you can prove that you're using the money in ways we approve." How patronizing can you get?

Rodents of Unusual Size - 2014-08-18

maybe because she's a completely crazy cunt that took all their kids to Africa for a year without telling him? Fuck this utter heartless, evil fucking cunt. She already took what he says to be millions of dollars from him. He didn't HAVE anything left. They demanded he pay more and he fled the country rather than spend the rest of his life in jail and/or commit suicide.

People with borderline personality disorder aren't real human beings. They are pure fucking evil.

Having been in a rather long relationship with someone diagnosed with BPD (while in the relationship), I can verify that there is no defense for this woman's behavior and all my sympathy rests with Foley.

Not only that, because of her diagnosis, she SHOULD be forced by the state to share with the father of her children how she spends the money that he gives her, especially given the history of insane shopping sprees which I can also personally attest to.

You have no idea what kind of mental and physical abuse people with BPD are able to spread across the world. I'm amazed she even got custody.

jangbones - 2014-08-17

North Carolina has the same one year waiting period to divorce...which I am currently enjoying.

Also, my wife is BPD, so I know Dave's pain all too fucking well.

blue vein steel - 2014-09-14

South Carolina is the same way for no-fault, but me and my ex are cool, so...

Nominal - 2014-08-17

I always wondered what caused him to age 30 years in the span of 5.

BorrowedSolution - 2014-08-17

The one judges decision during his income re-evaluation was an absolute reversal of the entire concept of justice (ie. what is fair and manageable by both parties). "What you are capable of paying is not as important as what you are 'obligated' to pay." Wow. That makes me feel slightly ill.

Failure To Pay

Southey's lawyer told PopEater via e-mail that "Mr. Foley agreed, voluntarily, with legal advice, to pay ,700 a month to support his children. He obviously agreed at that time that their expenses were in that range and that was their lifestyle. He agreed that this was what was required to maintain them in the lifestyle they were accustomed to.

"On the strength of that promise, Ms. Southey, with a grade 9 education, agreed to forego spousal support despite the fact that her income was totally uncertain and likely minimal. Mr. Foley acknowledged this his income could increase and he would not be required to pay more child support. He acknowledged that he was aware that his income could decrease and he would still have to pay the same amount. This was the deal that he voluntarily struck. His wife relied on his agreement to her detriment."

Despite the court-ordered agreement, "He stopped paying the agreed upon child support years ago when his income was still very high and when he still had the financial resources to comply with the agreement," says Mills. "He chose not to do so. The current order deals with the arrears that accumulated when his income was high but he did not pay what he agreed to pay."

Southey declined to comment for this story. But according to Southey's Factum -- a summary of the facts and her legal arguments she filed in 2007 when Foley tried to modify his payments – while Southey was struggling to raise their two children as a single mother with a modest income, Foley "was living a rather lavish lifestyle in LA in a house with a gardener and a pool. Ms. Southey and the children never had such a lifestyle and Ms. Southey has been plagued with requests for payments that Mr. Foley chose not to make."

To support her two children, Southey "has had to borrow and beg to make ends meet," the document states. "She lives in a modest house in a safe, but not rich or lavish part of Toronto, in the house that the family lived in together."

The Factum says that Southey is a mother who "is trying to raise these children in very difficult circumstances. Mr. Foley is centered in LA and sees the children only sporadically. Tabatha is the parent who needs to be there every day for the children."

As for the ,700 a month in child support she is supposed to receive, the document says, "She merely wanted her children taken care of in a manner that was consistent with Mr. Foley's income and the needs of the two children."

Foley had agreed to pay child support as well as the children's educational and medical expenses, the document says. "It was not long after the agreement was signed that Mr. Foley stopped paying the amounts agreed upon. He defaulted on school fees, medical expenses and unilaterally reduced the amount of child support. He did bring an application to reduce the support, but based on the agreement and his income post-separation, the judge determined that the support was appropriate and ordered him to pay it. If the agreement was not in place, Mr. Foley would have been ordered to pay approximately the same amount in spousal and child support.

"The amount Mr. Foley is now required to pay relate to a period when he was earning a high income, but he unilaterally decided not to pay. No judge has ordered him to pay more than his income for any year. He has been ordered to pay support for years in the past when he was earning a high income and chose not to pay. The amount he is now required to pay is the result of him not paying in prior years."

Foley had agreed to pay off the outstanding mortgage on the home they shared when he left, but never did so, leaving Southey to pay the mortgage, the document states. "She still cannot refinance the home or use her equity in it to assist in the costs of raising the children," it says. "Mr. Foley's obligation with respect to the mortgage was really minimal and he could have easily met his obligation in his years of high earnings, but he chose not to do it.

"Mr. Foley has only been ordered to comply with his obligations to his children. Nothing more, nothing less."

Rodents of Unusual Size - 2014-08-18

Guys have been committing suicide over this, by the way.

zerobackup - 2014-08-18

Sounds totally reasonable. I would like to also hear from his lawyers, as there are two sides to every awful breakup story. Also, honestly...just wait a long time (or be totally sure what you're getting into) when you have kids. People that have a kid within a year make me feel like they are just throwing the dice on the rest of their lives, you really have no idea how compatible you are until you've at least lived together for a couple years.

Bort - 2014-08-18

"On the strength of that promise, Ms. Southey, with a grade 9 education"

Oh great, a woman with the same level of education as Ricky from TPB. I'm so sorry, Dave Foley.

Mother Lumper - 2014-08-18

Pretty sure Dave Foley is a high school dropout himself.

Rodents of Unusual Size - 2014-08-18

All she wanted from him was a meal ticket. BPD means she should be in a straitjacket right now, spending the rest of her life in a padded cell. Instead, she's allowed access to children, which horrifies me.

Ever seen Dear Zachary?

baleen - 2014-08-18

If she is incapable of managing money I could see him being reluctant to take the normal judicial process seriously.
I'm sure when they are 18, he'll be able to assist them directly, unless he too is a total cunt.

MurgatroidMendelbaum - 2014-08-19

I sincerely hope Dave Foley has been squirreling away cash into a trust-fund offshore. I furthermore hope that the day those kids grow up and move out from their mom's house he is able to render all the back-pay directly to them, as she watches impotently from a distance. Just, like, briefcases full of cash.
He would naturally go to jail, but it would be OK; because at the same time, he would finally be free.

Big Name Celebrity - 2014-08-20

Jesus. Canada still has debtor's gaol....

Still: Newsradio auto-five.

Rodents of Unusual Size - 2014-08-21

The most frightening thing about this is how they demand money from you while in jail and it keeps going up astronomically until you pay. What the fuck.

Oh also America has been seeing this happen too (people going to jail for their debt), just not quite as frequently.
