I guess I'm just confused. I don't cross the border much (it's actually been since pre-9/11) and can't remember if the border patrol had the red shirts and beige hats, but to an American such as myself that's really cool; like the Buckingham Palace guards it's taking a picture of a person who is as iconic as the mountains behind them. I don't know, I'm sure I'd get in trouble if I was going through TSA and tried to take a picture of TSA agents, but I'd expect to be warned and no physical action taken. I mean this is like INTERPOL breaking down my door for putting on a VHS with a couple of people I don't know who decided it was good karma to throw down on a case of beer if they were going to watch the movie with me.
