But Dick Steel there knew how to handle the situation...it wasn't by the book, probably in breech of multiple department regs, and maybe illegal...but he's not some damn bureaucrat! He was there to get the job done, no matter what it took!

Marana police identified the armed man who was struck by a patrol vehicle last Thursday after he was pursued in connection with stealing a rifle from a Walmart and firing his weapon in the streets.

Mario Miranda Valencia, 36, is facing charges of discharging a firearm in city limits, aggravated assault on a police officer with a deadly weapon and shoplifting involving a firearm, according to a news release from Marana police.

Last Thursday morning, Marana police responded to an area near West Coca Cola Place between North Business Park Drive and Frontage Road for reports of firearm theft. Upon encountering the suspect, officers learned that his rifle was loaded.

The man put a gun to his head and refused to cooperate with officers, said Sgt. Chris Warren, a police spokesman. He began to walk down the street towards businesses and fired a shot.

No one was injured and officer did not return fire.

A patrol officer used his vehicle to knock the man down. He was taken to the hospital for medical treatment and arrested upon his release.

Valencia is also facing numerous charges in connection with crimes committed in Tucson city limits. Before the confrontation with police at the Marana Walmart, he was allegedly involved in an armed robbery, church fire, home invasion and auto theft.

For those of you that feel the need to Sunday night armchair quarterback this police officer, if you've done the job you have no business speaking. I have and from the limited knowledge I have of the case from the media, the officer did the right thing. There wasn't a shoot out that sent bullets all over the area,(a busy commercial area with hundreds of people), he stopped the suspect, and controlled a potentially dangerous and deadly situation for more than just the police officers and suspect. I also live and frequent the area, I am 110% grateful that all the law enforcement departments in my area, two of which I have worked for would have all taken similar action. As a citizen from the area I completely and whole heartily support this officer and the department, as well as the other two departments in the area. I trust them with my life, my family, and my home. I trust and know that they will respect my rights, and do all that they can to insure that I don't have to use deadly force, but will be fair and just if I have to. To the officer that made this decision, I thank you for doing your job, and duty to make MY community, an the community of MY FAMILY, safe. Well done, and thank you. To the officers with him, thank you for your efforts and diligence protecting our community.

moreover I looked up the police code for arizona, which isn't hard to do by the way -- this was totally justified under their justification section in the police code. Basically the unlawful discharge of a firearm in public is a felony.

13-3107. Unlawful discharge of firearms; exceptions; classification; definitions
A. A person who with criminal negligence discharges a firearm within or into the limits of any municipality is guilty of a class 6 felony.
B. Notwithstanding the fact that the offense involves the discharge of a deadly weapon, unless a dangerous offense is alleged and proven pursuant to section 13-704, subsection L, section 13-604 applies to this offense.

And with regards to the authorized use of deadly force by law enforcement, under the justification section, see item 3:

13-410. Justification; use of deadly physical force in law enforcement
A. The threatened use of deadly physical force by a person against another is justified pursuant to section 13-409 only if a reasonable person effecting the arrest or preventing the escape would believe the suspect or escapee is:
1. Actually resisting the discharge of a legal duty with deadly physical force or with the apparent capacity to use deadly physical force; or
2. A felon who has escaped from lawful confinement; or
3. A felon who is fleeing from justice or resisting arrest with physical force.


So yeah, he was fleeing from justice with deadly physical force used and still in hand, it's justified. Open and shut, the guy's going to jail and the cop is going to be patted on the back by all his fellow officers for possibly saving lives. These are the kinds of cops I want working for me in my town!

...but in all seriousness the asshole with the gun was walking "towards businesses" and so I'm really glad the cop did this. You stop, aim your tazer or gun, you can miss -- you can get shot at -- you can give the perp time to commit suicide. This car mauling was the swift surprise attack of JUSTICE baby.

Well it's hard to walk in any direction in a city or suburb without "heading toward (important sounding thing)"

I'm not going to go off on a bloodthirsty cop tangent here, but officer Dirk Action there didn't look like he had much awareness of the situation or coordination with the other officers.

Seemed like he just blows up into full blown Rambo mode soon as there was an excuse for it. Legal? Maybe. Justified or necessary? Debatable. I personally desire more restraint and professionalism from people with a license to kill.
